Prince George, British Columbia — April 28, 2015 — A B.C. Supreme Court judge’s ruling has awarded a former tow truck driver close to $260,000 in damages for long-term injuries stemming from a collision. The Prince George Citizen reports Robert Curry’s tow truck was rear-ended on February 24, 2012 after arriving on the scene of a fatal car crash on Highway 97, north of Quesnel. The 44-year-old loaded the defendant’s vehicle onto his truck, not feeling the effects of the impact until the next morning. Curry’s injuries have since rendered him physically incapable of returning to work. Justice Ron Tindale found the actions of the defendants—listed as Paul Powar and Northern Tire Capital Ltd.—caused injuries to the victim’s hip and neck, chronic pain and depression, awarding Curry $100,00 in non-pecuniary damages. The ruling awarded Curry an additional $72,000 for loss of future earning capacity, $58,240 for past wage loss, $20,543.68 for pain clinic costs and $8,000 for loss of housekeeping capacity—bringing damages to a total of $258,783.68.
